JUDGMENT

1. This is a petition under Section 29-A (4) of the Arbitration & Conciliation Act, 1996 (‘Act’) for extension of time in concluding the arbitration proceedings.

2. Learned counsel for the respondents submits that the respondent has no objection to the time being extended for completion of proceedings. He, however, contends that the petitioner has been responsible for the delay in completion of the proceedings. The said submission is however disputed and denied by the learned counsel for the petitioner. Nonetheless both the counsels assure that every effort would be made to complete the proceedings as soon as possible. 2019:DHC:5673 O.M.P.(MISC.)(COMM.) 412/2019

3. Learned counsel for the petitioner submits that the statutory period under Section 29(1) of the Act has expired on 27th May, 2019. He seeks a period of one year for completion of the proceedings and passing of the Award.

4. Without entering into the issue of the alleged delay on the part of the petitioner, with the consent of the parties, the time is hereby extended for completion of the proceedings and passing of the Award by a period of one year from 27th May, 2019.

5. It is made clear that none of the parties will seek unnecessary adjournments and every endeavour shall be made for conclusion of the proceedings, expeditiously.

6. Petition is disposed of in the aforesaid terms.
