ORDER
1. These are the applications under Section 438 ofthe Code of Criminal Procedure, 1973 (Cr. PC)filed by the petitioners for grant ofanticipatory bail.
2. Learned APP,on instructions ofthe Investigating Officer (10), submitted that after taking the admitted signatures of Jagdish Rai Seengal from Jabalpur, Madhya Pradesh, the questioned documents will be sent to the Forensic Science Laboratory (FSL) for expert opinion. Learned APP also submitted that the investigation is still at the initial stage, however,no arrest shall be made,till the time the FSL report is received by the 10. Learned APP also submitted that necessary directions be passed to the Director, FSL to expedite the process and send the report at the earliest. Accordingly, the ■r '6 Director, FSL is directed to go through the documents, as stated herein in above, and furnish a report to the 10 at the earliest, preferably within one month from the date of submission of documents by the 10.
3. Learned counsel for the petitioners submitted that in view of the statement made by the leamed APP, he may be allowed to withdraw the bail applications, with liberty to file fresh applications. Leamed counsel for the petitioners further submitted that if the need of arrest of the petitioners arises, the 10 may be directed to give three working days' notice to the petitioners so that they may avail legal remedy. Leamed counsel for the complainants as well as the leamed APP have no objection to the same. Accordingly, if need of arrest arises, the 10 shall give three working days' notice to the petitioners so that they may avail the legal remedy. Meanwhile, the petitioners are directed to join and cooperate in the investigation, as and when called by the SHO/IO in writing; they shall also not involve in any activity which may prejudice the prosecution and/or the witnesses.
