Quashing of FIR No. 208/2018, under Sections 420/468/471/120B IPC, registered at police station Dwarka (North), New Delhi is sought on the basis of Settlement-Agreement of 13th September, 2019 reached between the parties.
Learned counsel for petitioners submits that respondent No.3 is
2019:DHC:6002 W.P.(Crl.) 2923/2019 unable to move due to chronic joint pain and is therefore unable to appear before this Court.
Mr. Amit Peswani, Advocate, appearing on behalf of Ms. Nandita Rao, Additional Standing Counsel for respondent No.1/State submits that factum of respondent No.3 suffering from chronic joint pain stands verified and respondent No.2 is present in the Court and that she has been duly identified to be complainant of FIR in question by Investigating
Officer of this case.
Respondent No.2, present in the Court, submits that the dispute between the parties has been amicably resolved on the basis of
Settlement-Agreement of 13th September, 2019 and terms thereof have been fully acted upon. Respondent No.2 submits that now, no grievance against petitioners survives and so, the FIR in question and proceedings emanating therefrom be quashed.
Since the subject matter of the FIR in question stands mutually and amicably resolved between the parties, no useful purpose would be served in continuation of proceedings arising out of FIR in question.
In view of the above, FIR No. 208/2018, under Sections
420/468/471/120B IPC, registered at police station Dwarka (North) and the proceedings emanating therefrom, are hereby quashed qua petitioners.
This petition stands disposed of.
