JUDGMENT
1. Vide the present petition, the petitioner seeks direction thereby quashing FIR No. 39/2016 dated 04.02.2016, registered at PS Delhi Cantt. and all other proceedings emanating therefrom.
2. Notice issued.
3. Notice is accepted by learned APP for the State and counsel for the respondent no.2.
4. With the consent of the counsel for the parties, the present petition is 2019:DHC:6105 taken up for final disposal.
5. The present petition is filed on the ground that the parties have settled their disputes and the respondent no.2 has no objection if the present petition is allowed.
6. The petitioner and respondent no.2 to 4 have entered into an amicable settlement before Mediation Centre, Patiala house Court, New Delhi dated 13.12.2018.
7. The total settlement amount is ₹5,60,000/-(Rupees Five Lakhs Sixty Thousand only).It is submitted that the respondent No. 2 has already received an amount of ₹5,00,000(Rupees Five Lakhs only). A demand draft bearing No.002047 dated 16.09.2019 for the balance amount of ₹60,000/- (Rupees Sixty Thousand only) is handed over to the respondent No. 2 today in the Court.
8. Respondent No.2 is personally present in Court with learned counsel and has been identified by ASI Nand Kishore/IO and submits that matter has been settled and she does not wish to prosecute the matter any further.
9. Taking into account the aforesaid facts, this Court is inclined to quash the concerned FIR as no useful purpose would be served in prosecuting the petitioner any further.
10. For the reasons afore-recorded, the FIR No. 39/2016 dated 04.02.2016, registered at PS Delhi Cantt and consequent proceedings emanating therefrom are quashed.
11. The petition is allowed accordingly.
