ORDER

1. The present cross petitions have been filed by the Management and the workman assailing the award dated 05.02.2008, whereundcr the learned Labour Court after holding that the worlmian's termination from service was illegal had awarded her a lump sum compensation ofRs.1,50,000/-.

On 06.11.2019, learned counsel for the parties had jointly submitted that they were willing to amicably resolve the matter and 2019:DHC:7724 learned counsel for the Management, on instructions, had submitted that the Management had no objection to the release ofthe amount deposited by it before this Court being released in favour of the workman with interest accrued thereon and was willing to pay a further sum ofRs.50,000/- to the workman. Learned counsel for the workman had soughttime to get instructions.

Though learned counselforthe workman is not available today, the workman, who appears in person, submits that she is willing to settle the matter if she is paid a lump sum compensation of Rs.4,00,000/-. The photocopy ofthe voter's I.D. ofthe workman is taken on record. Pursuant to the directions on 06.11.2019, the Registry has informed that the amount deposited by the management has now risen to Rs.3,35,953/- in view ofthe interest earned on the said deposit.

In view of the aforesaid, with the consent of the parties, the impugned award is modified by directing the Registry to release the amount deposited by the Management in favour of the workman ^ namely Ms.Subhadra Devi, who is the petitioner in W.P.(C) No.5224/2008 and respondent in W.P.(C)No.237/2009,and directing the Managementto pay a further sum ofRs.65,000/- to the workman, within a period offour weeks. Upon receipt ofthe aforesaid amount, the workman will have no surviving claim againstthe Management.
