JUDGMENT

1. This public interest litigation has been preferred for the following prayers:- “a) Issue a Writ of Mandamus or any other Writ/directions to the Respondents to shift the protestors from Mandi House Periphery to other suitable place immediately and b) Issue a Writ of Mandamus or any other Writ/directions to the Respondents to open the Sikandra Road (One-way from ITO to Mandi 2019:DHC:6771-DB WP(C) No.12966/2019 House Periphery) and Bhagwan Dass Road (Two-way from red light on Tilak Marg to Mandi House Periphery) for public traffic immediately. c) Issue a Writ of Mandamus or any other Writ/ directions to Respondents to not permit/allow use of a public road for a protest and d) Issue further necessary directions/guidelines to the respondents to deal with such situations in future and for fixing the liabilities of the wrongdoers/illegal protestors/authorities as deem necessary by this Hon’ble Court.”

Having heard counsel for both the sides and looking to the facts and circumstances of the case, it appears that this petitioner is in search of shifting of the protesters from Mandi House periphery to any other suitable place in the city of Delhi and for opening of the road mentioned hereinabove in the prayer clause (b).

3. It is therefore directed that this petition shall be treated as representation by the respondent nos.[3] & 4 and the same shall be decided in accordance with law keeping in mind the permissions, if any, given by the Police to the protesters; effect on the traffic and inconvenience caused to the public at large.

4. With these observations, this writ petition is hereby disposed of.
