JUDGMENT

1. This is a petition under Section 11 of the Arbitration and Conciliation Act, 1996 seeking appointment of Arbitrator.

2. Ms. Padma Priya, Advocate enters appearance on behalf of the respondent. She submits that respondent has no objection to the Arbitrator being appointed. Both the parties jointly agree that instead of Arbitral Tribunal of Three Members envisaged in the arbitration clause, Sole Arbitrator may be appointed to adjudicate the disputes between the parties.

3. With the consent of the parties Mr. Justice Vinod Goel, Former Judge of this Court, is appointed as a Sole Arbitrator to adjudicate the disputes between the parties. 2019:DHC:6570 ARB.P. No.723 /2019

5. The learned Arbitrator shall give disclosure under Section 12 of the Act before entering upon reference.

6. Fee of the Arbitrator shall be fixed as per Fourth Schedule of the Act.

7. Learned counsel for the respondent seeks liberty of the Court to raise counter claim before the Sole Arbitrator.

8. Liberty is granted to the respondent to raise counter claim in accordance with law.

9. The petition is disposed of along with the pending applications in the aforesaid terms.
