ORDER
1. Learned counsel for the petitioners submitted that the petitioners were granted bail by the Trial Court on 6.4.2017, however, petitioner in Bail Appn. No.2761/2019 could not appear before the Trial Court on 20.9.2019 due to death ofone ofhis close relatives(BuaJ. Similarly, petitioner in Bail Appn. No.2781/2019 could not appear before the Trial Court on 20.9.2019 due to his illness. Thereafter, the Trial court issued NBWs against the petitioners and they were taken into custody 2019:DHC:7976 on 30.9.2019 and 11.10.2019 respectively and have heen in judicial custody since then.
2. Learned counsel for the,petitioners, on behalf of the petitioners,undertakes thatthe petitioners shallregularly appear before the Trial Court,in case bail is granted to them.However, in case any ofthe petitioners remains absent or does not appear before the Trial Court on the date so fixed before it, the Trial Court may pass appropriate orders by taking into consideration their conductin future.
3. Taking into consideration the aforesaid factors and the submissions of the learned counsel for the petitioners and the fact that the petitioners were earlier granted bail by the Trial Court,this Courtfinds these to be fit cases,atthis stage,for the grant of bail to the petitioners. Ordered accordingly. The petitioners be released on bail,ifnotrequired in any other case, subject to their fumishing personal bonds in the sum of Rs.25,000/- each,with one surety each ofthe like amountto the satisfaction of the Trial Court. It is clarified that in case the ^ petitioners fail to appear before the Trial Court on any date in future, in that eventuality, their conduct be taken into consideration by the Courts and appropriate orders be passed accordingly.
4. Applications are disposed ofinthe above terms.
