JUDGMENT
1. Pursuant to the Court notice issued by this Court on the last date of hearing, counsels have appeared on behalf of the parties. They jointly submit that a substitute Arbitrator be appointed by this Court.
2. With the consent of the parties, Hon’ble Mr. Justice H.R. Malhotra, former Judge of this Court, is appointed as a Sole Arbitrator to adjudicate the disputes between the parties.
3. Mandate of Mr.Justice Rajender Menon is terminated as Justice Menon has withdrawn from the proceedings on account of his current appointment as Chairman, Armed Forces Tribunal.

5. The learned Arbitrator shall give disclosure under Section 12 of the Act before entering upon reference.
6. Fee of the Arbitrator shall be fixed as per Fourth Schedule of the Act.
7. Needless to say that new Arbitrator will resume proceedings from the stage at which they were left by Mr. Justice Rajender Menon.
