JUDGMENT

1. When the matter is called out, nobody appears on behalf of the petitioners.

2. This Public Interest Litigation has been preferred with the following prayers: “(a) issue of writ, order (s) or direction (s) in the nature of mandamus directing Respondents to construct 500 Bedded Hospital at 2019:DHC:6996-DB J.J. Colony, Madipur, Delhi, in time bound manner with adherence to specific timeline and: (b) issue of writ, order (s) or direction (s) in the nature of mandamus directing Respondent No. 1, to initiate inquiry through independent investigative agency or to conduct administrative enquiry into the inordinate delay in construction of the earlier 200 Bedded Hospital and now upgraded 500 Bedded Hospital and to take appropriate actions, as per law, against the officials responsible for the delay and:

(c) pass any other order or orders this Hon’ble Court may deem fit &

3. We have learned counsel for Respondent Nos.[1] to 4.

4. It is submitted by learned counsel for Respondent No.4 that the plot in question was earlier encroached and now the encroachment has been vacated by the actions of Respondent No.4.

5. Learned counsel for Respondent Nos. 1 to 3 submitted that at the plot in question, a hospital is to be constructed for which tender has already been floated and a notice inviting tender has been published on 11th December,

2019.

6. In view of these submissions of learned for Respondent Nos. 1 to 3 and learned counsel for Respondent No. 4, we see no reason to further monitor this case.

7. Nonetheless, we expect from the respondents that the construction, as envisaged by the respondents, is completed at the earliest in the interest of the public at large.

8. With these observations, this writ petition is hereby disposed of. CM APPL. 8820/2018 (for directions) In view of the order passed in the writ petition, this application is disposed of.
