JUDGMENT
(ORAL)

1. Vide the present petition, the petitioner seeks direction thereby quashing of FIR No. 313/2012 dated17.09.2012, registered at Police Station Khajuri Khas and all other proceedings emanating therefrom.

2. Notice issued.

3. Notice is accepted by learned APP for the State and counsel for the respondents.

4. With the consent of the counsel for the parties, the present petition is taken up for final disposal. 2020:DHC:107

5. The present petition is filed on the ground that the parties have settled their disputes and the respondents have no objection if the present petition is allowed.

6. Respondent nos. 2 & 5 are personally present in Court with learned counsel and they have been identified by SI Vipin Teotia /IO and submits that matter has been settled and they do not wish to prosecute the matter any further. Respondent no.5 has today placed special power of attorney on behalf of the other LRs before this Court as directed vide order dated 03.12.2019.

7. The petitioner and respondent no.2 have entered into an amicable settlement.

8. The total settlement amount is ₹2,50,000/-(Rupees Two Lakhs Fifty Thousand only). It is submitted that the respondent no.2 has already received an amount of ₹2,00,000/- Rupees Two Lakhs Only). A demand draft bearing No.729405 dated 17.12.2019 for ₹ 10,000/- (Rupees Ten Thousand) and another demand draft bearing No. 729404 dated 17.12.2019 for ₹40,000/- is handed over to the respondent No. 2 today in the Court.

9. Taking into account the aforesaid facts, this Court is inclined to quash the FIR as no useful purpose would be served in prosecuting the petitioners any further.

10. For the reasons afore-recorded, the FIR No. 313/2012 dated17.09.2020, registered at Police Station Khajuri Khas and consequent proceedings emanating therefrom are quashed.

11. The petition is allowed and disposed of accordingly.
