JUDGMENT

1. The petitioner assails the decision to disqualify him from induction into the Central Armed Police Forces[1], owing to his cardiac condition.

2. We find that the reports of the DME[2] and the RME[3] differ from each other in so far as the Tachycardia from which the petitioner is stated to be suffering is concerned. Moreover, it does not appear that either of the Boards includes a qualified Cardiologist.

3. In these circumstances, we had suggested to the respondent that we could dispose of the matter by directing the petitioner to be CAPF Detailed Medical Examination examined by a Cardiologist who would give her qualified opinion as to whether the petitioner actually suffer from Tachycardia.

4. Mr. Syed Abdul Haseeb, learned CGSC, on instructions, is agreeable to a disposal of this petition with a direction that the petitioner be examined by a qualified Cardiologist in the Army Research and Referral Hospital.

5. Accordingly, let the petitioner be examined by a qualified Cardiologist in the Army Research and Referral Hospital. The Cardiologist would also be provided copies of the DME and the RME reports.

6. The Cardiologist would arrive at an informed decision as to whether the petitioner suffers from Tachycardia as would disqualify him from being recruited in the CAPF.

7. We request the Medical Superintendent of the Army Research and Referral Hospital to have the petitioner examined by a competent Cardiologist on 21 October 2025 for the aforesaid purpose.

8. Ms. Esha Mazumdar, who appears for the petitioner, submits, on instructions, that his client would abide by the decision of the Cardiologist of the Army Research and Referral Hospital. Needless to say, if the petitioner is found medically fit for the post, he would be entitled to be appointed at par with other persons who were found fit and appointed. Review Medical Examination
