07.02.2020 Vide the present applications, petitioners/applicants seek anticipatory bail in the event of their arrest in FIR No.' 299/2019 dated 02.12.2019 registered at Poliee Station - Sonia Vihar for offences punishable under
Sections 304B/498A/34 IPG.
It is made clear that applicant in BAIL APPLN.3063/2019 is brother in law(Jeth)ofthe deeeased,applicant in BAIL APPLN.3065/2019 is sister is law (Nanad) of the deceased and in BAIL APPLN. 3068/2019 is son of the applicant in BAIL APPLN.3065/2019.
It is not in dispute that pursuant to the directions passed by this Court all applicants have joined investigation and chargesheet is at final stage.
However, chargesheet against husband of the deceased has already been filed. Thus,they are no more required for investigation.
In view of above, this Court is of considered view that the present case is fit for anticipatory bail. The SHO/ Arresting Officer/IO eoneemed, is hereby direeted that in the event of arrest, the petitioners/ applieants be released on bail on the following teiins and conditions
(i) Petitioners shall furnish a personal bond in the sum of T15,000/- each with one surety in the like amount subject to the satisfaetion of
Arresting Officer/SFIO/IO concerned;
(ii) Petitioners shall cooperate with the investigation and make themselves available for interrogation by police officer, as and when required;
In case ofdefault ofaforementioned conditions, the State is at liberty to take appropriate recourse in accordance with law.
Before parting with the order, it is relevant to mention that nothing contained in this order shall be construed as an expression on the merits of the case.
Accordingly,applications stand allowed and disposed of.
