The petitioners have filed the present petition under Section 482 of the Code of Criminal Procedure, 1973 for quashing of FIR No. 125/2018, under Sections 323/341/354/354A/354B/506/34 of the Indian Penal Code, 2020:DHC:1062
1860, registered at P.S.: Shakarpur, Delhi and the proceedings emanating therefrom.
Learned Additional Standing Counsel (Criminal) for the State submits that the petitioners and respondent nos.2 to 4 are neighbours. A dispute over a trivial issue led to the registration of the aforementioned
FIR against the petitioners.
Learned Additional Standing Counsel (Criminal) for the State submits that there is a cross FIR No. 130/2018 under Sections 323/341/34 registered at police station Shakarpur, Delhi.
Learned counsel for the petitioners submits that the abovementioned FIR stands disposed of as the same stands compounded on 6th January, 2020.
The Investigating Officer, who is present in Court, has identified the petitioners as well as respondent nos. 2 to 4.
The petitioners and respondent nos. 2 to 4 have submitted that due to intervention of respectable members of the society the matter has been compromised between them vide Compromise Deed dated 18th January, 2020.
Respondent nos. 2 to 4 reiterated the aforesaid facts and submitted that they have amicably settled their dispute without any pressure or coercion from any source whatsoever. Respondent nos.2 to 4 have further submitted that they have no objection if the FIR is quashed and the petition is allowed.
In view of the above settlement arrived at between the parties, this
Court is of the view that no fruitful purpose would be served in keeping the parties entangled in the criminal proceedings. Accordingly, in the interest of justice, FIR No. 125/2018, under Sections
323/341/354/354A/354B/506/34 of the IPC registered at P.S.: Shakarpur, Delhi and the proceedings emanating therefrom are quashed.
Petition stands disposed of accordingly.
