SANJEEV SACHDEVA, J. (ORAL)

1. Petitioner impugns order dated 17.05.2019, whereby the appeal filed by the petitioner, impugning judgment dated 11.11.2014 passing a decree of eviction, was dismissed.

2. Respondent had filed the subject eviction petition seeking eviction of the petitioner from one shop measuring 9½ X 9½ on the ground floor of property/Khasra No.877/1, Ram Gargh, Near Red Light Chowk, Jahangirpuri, Delhi.

3. By the impugned judgment dated 17.05.2019, petitioner was 2020:DHC:1633 CM(M) 1307/2019 granted two months’ time to vacate the premises.

4. Before this court on 28.01.2020, petitioner had undertaken to vacate the tenanted premises and hand over the same to the respondents on or before 31.08.2020 and to clear the entire arrears of rent on or before 30.04.2020. Petitioner was directed to file an affidavit of undertaking in terms of order dated 28.01.2020.

5. Petitioner has filed the affidavit of undertaking on 20.02.2020 and has undertaken to vacate and handover the peaceful vacant possession of the property in question on or before 31.08.2020 and to clear the arrears as per the original eviction decree on or before 30.04.2020. The undertaking is accepted.

6. Petition is, accordingly, disposed of in terms of order dated 28.01.2020 as well as the undertaking filed by the petitioner.
