JUDGMENT
1. Present writ petition was filed by the Petitioner in the nature of quo warranto seeking directions to declare the actions of Respondent No. 1 in not withdrawing the appointment of the Dean/Head of Department of the University of Delhi and continuing Respondent No. 3 in the said position in Netaji Subhas University of Technology (NSUT). 2020:DHC:2934
2. Pursuant to the last date of hearing, Mr. Mohinder J.S. Rupal who appears on behalf of the University has filed an affidavit. The same is taken on record.
3. Mr. Rupal has categorically stated in para 5 of the affidavit that as per the University of Delhi Notification dated 27.09.2017, Respondent No. 3 was appointed as the Head of Department and Dean of Faculty of Technology for a term of three years with effect from 27.09.2017 for facilitating the completion of academic activities of students admitted during the academic session 2018-19 in the erstwhile NSIT affiliated to the University of Delhi.
4. Para 6 contains a categorical stand of the University that the tenure of Respondent No. 3 has come to an end on 26.09.2020 by way of the said Notification and that he shall cease to be the Head of Department and Dean of Faculty of Technology forthwith. With the completion of the tenure he shall cease to have any charge related to Dean with effect from 27.09.2020.
5. Relevant paras of the affidavit are as under:- “5. As per University of Delhi notification 27.09.2017 Prof. Sachin Maheshwari has been appointed as the Head of Department and Dean of Faculty of Technology for a term of three. years with effect from 27.09.2017 for facilitating the completion of academic activities of students admitted during the academic session 2018-19 in the erastwhile NSIT affiliated to the University of Delhi.
6. The said tenure of Prof Sachin Maheshwari has to come to an end on 26.09.2020 and shall cease to be Head of Department and Dean of Faculty of Technology forthwith. With the completion of this tenure of Prof Sachin Maheshwari shall cease to have any charge related to Dean.”
6. Mr. Tarkeshwar Nath appearing for Respondent No. 3 acknowledges the fact that the tenure of Respondent No. 3 has ended and he ceases to be the Head of the Department and Dean of the Faculty of Technology with effect from 26.09.2020.
7. Having gone through the affidavit, Mr. K.C. Mittal learned counsel for the Petitioner fairly and candidly submits that no further directions are required to be passed in the present writ petition as the reliefs sought are satisfied.
8. In view of the Affidavit of the University no further orders are required to be passed in the present petition and the same is accordingly disposed of along with the accompanying application.
