CORAM:
JUSTICE PRATHIBA M. SINGH Prathiba M. Singh, J.(Oral)
JUDGMENT

1. This hearing has been held through video conferencing.

2. Further to the last order, Mr. Satyakam, ld. counsel has placed on record a status report in respect of the policies to be availed from the Life Insurance Corporation of India (hereinafter, “LIC”) and the New India Assurance Company Limited (hereinafter, “NIAC”). In terms of the last order, Mr. Hemant Buch, Chief/P&GS (Marketing/Govt Business & Compliance) LIC of India, Central Office, Mumbai has joined the video conference hearing today.

3. After perusing the status report and hearing the ld. counsels appearing in the matter as also Mr. Hemant Buch, the following directions are issued: i) The premium amount, as per order dated 7th October, 2020, shall now be paid to LIC by the GNCTD on or before 20th November, 2020. The bank account details of LIC shall be communicated by Mr. Kamal 2020:DHC:3234 W.P.(C) 3298/2020 Mehta to Mr. Satyakam, by 13th November, 2020; ii) The complete list of lawyers who would be the beneficiaries of the Group Insurance Policy shall also be informed to the LIC by the GNCTD, by way of a letter by 20th November, 2020 or simultaneously at the time of payment of the premium; iii) The Group Insurance Policy shall be issued by LIC on or before 30th November, 2020; iv) Certificates of Insurance in the names of each of the individual lawyers who are the beneficiaries shall be issued by 15th December,

2020.

4. All the remaining directions given in order dated 7th October, 2020 shall continue to bind the parties. Insofar as the Medi-claim policy is concerned, the same shall also be purchased on or before 30th November, 2020 and the premium shall be transmitted to the NIAC well in time so as to ensure that the policies are issued by the NIAC on or before 30th December,

2020.

5. Insofar as Point Nos. A, B and C of paragraph 3 of the status report are concerned, Mr. Hemant Buch submits that the Delhi office of LIC would be in contact with the GNCTD. Insofar as Point No. D i.e. verification of list of lawyers is concerned, Mr. Satyakam submits that the list already stands verified but if the GNCTD wishes to do a double check, they will ensure that the same does not delay the paying of the premium by 20th November, 2020. Insofar as Point No. E for deposit of bank guarantee is concerned, since LIC is before this Court and the purpose of a bank guarantee is only to secure the premium paid, LIC being a state corporation, the condition of bank guarantee shall not be insisted upon by the GNCTD at this stage. 2020:DHC:3234 W.P.(C) 3298/2020

6. After the issuance of the policy and the certificates of insurance, if there is any reconciliation required, the same shall be done on or before 25th December, 2020. The NIAC policies shall also adhere to a similar schedule and the condition of bank guarantee shall not be insisted upon at this stage.

7. List on the date already fixed i.e. 27th November, 2020.
