JUDGMENT
The hearing has been conducted through video conferencing.
Crl. M.A. 3022/2021 (exemption)
1. Allowed, subject to all just exceptions.
2. Applications are disposed of. Crl.M.A.3051/2021 (for directions)
3. In view of the reasons mentioned in the present application and for welfare of the parties, I hereby allow the present application and direct the 2021:DHC:720 Registry to remove judgment dated 08.01.2019 passed in Crl.Rev.P. 146/2017 titled as Pankaj Chawla vs. Divya Kapoor and Crl. Rev. P. 172/2017 titled as Divya Kapoor vs. Pankaj Chawla from the www.indiankanoon.org and www.casemine.com.
4. It is further directed that copy of the afore-mentioned judgment shall not be provided to any of the parties except the parties therein.
5. Application stands disposed of.
6. Vide the present petition, petitioners seek direction for quashing of FIR No. 1425/2014, registered at Police Station Hari Nagar and consequent proceedings arising therefrom.
7. Notice issued.
8. Notice is accepted by learned APP for State and by respondent no.2 and with the consent of counsel for parties, present petition is taken up for final disposal.
9. Petitioner no.1 and respondent no.2 got married on 30.01.2013 as per Hindu rites and rituals. Due to extreme incompatibilities between petitioners and respondent no.2, they started living separately from 10.04.2014.
10. Petitioner no.1 and respondent no.2 with the intervention of their well wishers and relatives entered into an amicable settlement vide Memorandum of Understanding dated 26.10.2020 and settled all their disputes amicably.
11. Complainant/respondent no.2 is present in person through video conferencing and has been identified by WSI Satyawati of Police Station Hari Nagar and submits that matter has been settled and she does not wish to prosecute the matter any further.
12. Taking into account the aforesaid facts, this Court is inclined to quash FIR as no useful purpose would be served in prosecuting petitioners any further.
13. For the reasons afore-recorded, FIR No. 1425/2014, registered at Police Station Hari Nagar and consequent proceedings emanating therefrom are quashed.
14. The petition is, accordingly, allowed and disposed of.
