29.04.2021 The proceedings in the matter have been conducted through video conferencing.
ORDER
1. Dr. M.K. Gahlaut, learned counsel for the petitioners, states that the captioned writ petitions are to be listed alongwith W.P.(C)6735/2020, which has been adjourned en bloc to 14.07.2021. Dr. Gahlaut states that the counter affidavits have been filed in all these petitions and he does not wish to file rejoinders.
2. The above mentioned,writ petitions concern admission of students to Adriel High School ["the School"] in the EWS category. The petitioners have approached this Court with the contention that despite being recommended for admission by the Directorate of Education, GNCTD, the School had struck off their names. By interim orders granted in these petitions, the School was directed not to strike off the names ofthe petitioners from the rolls for non-payment offees.
3. The petitioners filed the aforementioned contempt petitions alleging non-compliance ofthe interim orders passed by this Court.
4. In the contempt petitions, the Principal ofthe School has filed an undertaking to the following effect:xxxx xxxx xxxx
2. That I undertake to allow the student to attend the class and shall not strike offname ofthe studentfrom the role ofthe school. 3. ThatIfurther undertake to abide by all the terms and conditions and the directions ofthis Hon'ble court."
5. Although the contemnors are not represented today, Dr. Gahlaut states that the students in question have been given access to online classes by the respondent-School and are, in fact, now attending onlinej classes. Consequently,in view ofthe undertaking given,he does notpress the contempt petitions,atthis stage.
6. CONT.CAS.. (C) 159/2021, 171/2021 and 188/2021 are accordingly disposed of.
