JUDGMENT

1. After hearing for some time, learned Counsel for both sides are agreeable to a disposal of this writ petition, which is directed against an interim order passed by the Armed Forces Tribunal[1] in OA 948/2017, with a request to the Tribunal to decide the OA itself finally within a time to be fixed by this Court.

2. We are informed that the OA is listed before the Tribunal on 24 November 2025. “the Tribunal” hereinafter W.P.(C) 7766/2025

3. We request the Tribunal, if possible, to take up the OA on the said date itself for final hearing or on any short date, thereafter, as per convenience of the Tribunal, and to endeavour to dispose of the OA as expeditiously as possible.

4. The costs of ₹ 25,000/- imposed on the petitioner is waived.

5. Needless to say, the Tribunal, while hearing the matter, would not be influenced by any of the observations contained in the impugned order, as it is purely interim in nature.

6. All questions of facts and law are open to be argued before the Tribunal on the next date of hearing.

7. To facilitate the hearing, we direct both sides to place on record short notes of their respective submissions not exceeding five pages each, after exchanging copies with each other, at least a week in advance of the next date of hearing before the Tribunal.

8. The petition is disposed of in the above terms.
