JUDGMENT

1. In view of the objections raised by the Court, predicated on, inter alia, the judgement of a learned Single Judge in Havells India Ltd v. Advertising Standards Council of India, Mr. Mehta, learned Senior Counsel, seeks leave to withdraw this suit with liberty to re-file the suit as a non-commercial suit on the Original side of this Court.

2. He submits that the requisite court fee would be paid with the suit, as and when filed, failing which an appropriate application would be filed in that regard. (2016) 227 DLT 719 2021:DHC:1750

3. Leave and liberty is granted as aforesaid.

4. This suit is permitted to be withdrawn.

5. In view of the urgency expressed in this matter, the Registry is requested to list the suit as and when it is filed, as early as possible.
