JUDGMENT

1. This is an application under Order XXIII, Rule 3 of the Code of Civil Procedure, 1908 (CPC), for decreeing of the suit in terms of the settlement between the parties, the terms of which have been enumerated in Paras 2 and 8 of the application. I.A. 9096/2021(under Order XXIII, Rule 3 of the Code of Civil Procedure, 1908 (CPC)- for decreeing of the suit in terms of the settlement between the parties)

2. The terms of settlement, as enumerated in Paras 2 and 8 of the 2021:DHC:2223 CS(COMM) 58/2021 application, would, therefore, be treated as a part of this order and the parties shall remain bound thereby.

3. The present suit is, therefore, decreed in terms of the settlement arrived at between the parties.

4. The Registry is directed to draw up a decree sheet accordingly.

5. The petitioner is also entitled to refund of 50 % of the court fees deposited.

6. The application stands allowed and the suit stands decreed.
