This public interest litigation has been preferred for following prayers:- “(i) To issue a writ, order or direction in the nature of mandamus, directing to respondent for the issuance of certificate of vending as per the direction given by the secretary, ministry of housing and urban affairs, Govt. Of India letter dated 18.05.2021 letter Reference NO. 2021:DHC:2076-DB D.O No. K-12017(30)/6/2020-upa-ii–UD-Part(l) within a month as per the instructions had been issued to States/UTs to the vendors who have been issued Letter Of Recommendation(LOR) under PM Svanidhi Scheme.

2. We have heard the Petitioner, who appears in person and learned counsels for the Respondent. Petitioner seeks a direction for issuance of Certificates of Vending to the eligible street vendors, in whose favour Letters of Recommendation (LOR) have been issued under the PM Svanidhi Scheme. In the writ petition, Petitioner has averred that LORs have been issued in favour of 85 ‘Permission Holder Vendors’.

Having heard the Petitioner and the counsels for the Respondent and looking to the facts and circumstances of the case, we hereby direct that the Respondent shall verify the facts mentioned in the present writ petition as well as in the representation dated 24.06.2021 (Annexure P-3 to the memo of this petition), already preferred by the Petitioner and take a decision for grant or otherwise of the Certificates of Vending, in accordance with law, rules, regulations and Government policies applicable to the facts of the case. The decision shall be in respect of the 85 vendors on whose behalf the representation dated 24.06.2021 was preferred.

4. The entire exercise shall be completed as early as possible and preferably within a period of 6 weeks from the receipt of the copy of the order of this Court.

5. Needless to state that if any vendor, as aforesaid, is aggrieved by nongrant of the Certificate, he shall be at liberty to resort to appropriate remedies available in accordance with law.

6. With these observations, the writ petition is hereby disposed of.
