JUDGMENT

1. The petition has been heard by way of video conferencing. MANMOHAN, J. (Oral)

2. Present writ petition has been filed seeking directions to the Respondent No. 2 to submit/forward the Petitioner’s application dated 25th March, 2021 for the post of Lower Division Clerk (LDC) on inter-departmental transfer along with requisite documents/approvals and no objection certificate [NOC].

3. Learned counsel for the Petitioner states that the Petitioner was appointed by GREF Centre, Pune as an LDC. He states that the Petitioner sought transfer to Respondent No. 4 (Ministry of Communication and IT Department of Posts). 2021:DHC:2884-DB W.P.(C) 10232/2021

4. He states that the parent Department as well as borrowing Department have issued ‘No Objection Certificates’. He emphasises that Jodhpur, Chetak and Chandigarh offices of the respondents have already given their ‘No Objection Certificates’. He emphasises that only ‘No Objection Certificates’ from Respondent No. 2 remains to be issued. He states that in the event the said ‘No Objection Certificates’ is not issued immediately, his application for inter-departmental transfer may become infructuous.

5. Keeping in view the limited prayer sought, the present writ petition is disposed of with a direction to Respondent No.2 to decide Petitioner’s request for inter-departmental transfer in accordance with law within four weeks. It is made clear that this Court has not commented on the merits of the transfer sought. The rights and contentions of all the parties are left open.
