JUDGMENT

1. The petition has been heard by way of video conferencing. MANMOHAN, J. (Oral)

2. With consent of the parties, the writ petition is taken up for hearing and disposal.

3. Though a number of prayers have been made in the present writ petition, yet with the consent of the parties, the present writ petition is disposed of in the following agreed terms:-

A. Petitioner undertakes to join her new posting at Sector BSF,
B. In the event, the petitioner after joining her new posting applies for treating her absence from 16th
C. Respondents undertake to re-constitute the Internal

Complaints Committee (for short ‘ICC’) in accordance with the order dated 18 April, 2021 till the date of her joining as leave, the said request shall be considered by the respondents in accordance with law. th

D. Petitioner’s application for security as and when filed shall be considered by the respondents in accordance with law. June, 2021 passed by the Director- General, BSF, within two weeks. The petitioner undertakes to co-operate in the said inquiry. Counsel for the respondents assures this Court that as and when the petitioner applies for leave to participate in the ICC proceedings, the said request will be allowed in accordance with law.

4. The statements/undertakings made by the counsel for the parties are accepted by this court and the parties are held bound by the same.

5. This Court directs that the re-constituted ICC shall conclude the inquiry as expeditiously as possible. Respondents are directed to ensure that communications between the petitioner and the ICC are kept confidential.

6. Recording the aforesaid consensus and directions, the present writ petition along with pending applications stands disposed of. This court clarifies that it has not expressed any opinion on the merits of the case. The rights and contentions of all the parties are left open.
