Allowed, subject to all just exceptions.
Application stands disposed of.
1. Present Public Interest Litigation has been preferred seeking the following reliefs: “a) Direct respondent no. 2 and 3 to open and make fully functional immediately the Mother Dairy Fruits and Vegetables Shop in A Block, Sector - 19, Noida. b) May also kindly direct respondent No. 2 and 3 to fix and sell fruits & vegetables at reasonable rates keeping in view the fact that respondent No. 2 and 3 was established with main function to cater to the needs of common man for procuring fresh fruits & vegetables at reasonable prices.” 2021:DHC:3549-DB
2. Learned counsel for the Petitioner submits that despite a representation having been made by the Petitioner on 19.10.2021 to Respondent No.3, there has been no response and the residents are suffering on account of the Mother Dairy outlet in the concerned area not being made functional.
3. Learned counsel appearing on behalf of Respondent No.3 fairly submits that the answering Respondent has already initiated steps to operate the concerned outlet and as soon as the vendor is finalized, the Mother Dairy booth shall be made functional.
4. In view of the aforesaid submissions, we hereby direct the Respondents to look into the grievances ventilated by the Petitioner in the present petition treating the same as a representation in addition to the representation dated 19.10.2021, which is pending with Respondent No.3, and take a decision in accordance with law, as expeditiously as possible but not later than eight weeks from today.
5. We direct the Registry to supply a copy of the writ petition to learned counsel appearing on behalf of Respondent No.3 on the counsel furnishing the email ID to the learned Court Master.
6. Liberty is reserved with the Petitioner to revive the present petition in case the need so arises.
7. With these observations, writ petition is hereby disposed of.
