JUDGMENT

1. Petitioner seeks a direction to the respondent to grant an electricity connection to the premises in occupation of the petitioner being the first floor of House No.1215, Behind DC Office, Nala Road, Kapashera, New Delhi.

Learned counsel appearing for BSES Rajdhani Power Ltd submits that the said respondent does not have any objection to grant 2021:DHC:3468 W.P(C) 11243/2021 2 of an electricity connection subject to obtaining NOC from the other owners of the property. He submits that as per the documents apart from the petitioner, his brother Ashok Gupta and respondent No.2 are the owners of the property.

3. An NOC from Mr. Ashok Gupta has been annexed as Annexure P-6.

4. Learned counsel appearing for respondent No.2 submits that in case the connection is being applied for only in respect of the first floor of the subject property he has no objection to grant of the electricity connection.

5. In view of the above, petition is disposed of with a direction to the respondent BSES Rajdhani Power Ltd to expeditiously consider the application of the petitioner in accordance with law and in case the application is allowed, grant the connection forthwith. Petitioner shall comply with the requisite commercial and other formalities for the grant of the connection.

6. It is clarified that the grant of the electricity connection will be without prejudice to the rights and contentions of the co-owners of the property.
