JUDGMENT

1. Petitioner/tenant/Judgment Debtor has assailed order dated 17.10.2025 of the learned execution court, whereby fresh warrants of possession of immovable property were ordered with directions to the local police to ensure that the Bailiff is able to break open locks or remove any hindrance, because in the earlier attempt, Judgment Debtor and his relatives did not allow execution of possession warrants. Further, learned counsel for DH also informed the execution court that Judgment Debtor had already vacated the subject property after locking the same.

2. Learned counsel for petitioner/tenant/Judgment Debtor at the outset, refers to the contents of the petition and requests only for some reasonable time to vacate. After some discussion, the petitioner personally present in CM(M) 2167/2025 pages the courtroom and identified by learned counsel undertakes to vacate the subject property within 15 days from today. Therefore, it is directed that the warrants of possession be not executed till 30.11.2025. But, it is made clear that no further indulgence shall be granted to the petitioner/tenant/Judgment Debtor.

3. Accordingly, the present petition is disposed of, making it clear that the warrants of possession already issued against the petitioner shall remain alive, but would be executed only after 30.11.2025, if the petitioner does not vacate the subject property by that day.
