14.12.2021 The hearing has been conducted though hybrid mode (physical and virtual hearing).
ORDER

1. The learned counsel for the respondents submits that compliance orders have been passed for granting permission or rejecting the application ofthe petitioners concerned.

2. An e-copy ofthe minutes ofthe meeting have been communicated to 2021:DHC:4449 L the learned counsel for the parties. It will be open to the petitioners to pursue their remedies as may be available in law. \

3. Compliance has been done, albeit only after issuance of notice in these contempt petitions. The petitioners have incurred expenses in filing these contempt petitions. They have suffered undue harassment, and the institutions have lost out on a year in admitting protective students.

4. Since there is a delay in complying with the court's directions, the court is inclined to impose costs of Rs.19,000/- in each case. However, upon persuasive requests by the learned counsel for the NOTE,the costs are reduced to Rs.11,000/- in each case.

5. The issue regarding damages as may have been caused to the petitioners cannot be determined in these cases.In the circumstances, let costs of Rs.11,000/-, in each case, be deposited with the DCF (South), GNCTD. Depending upon the soil type, suitability and topography, Amaltas, Pilkhan, Papdi, Kachnaar, Goolar and Kala Siris/Safed Siris may be planted on the southern side ofNH-24 along the road going towards NOIDA. The land forms a part ofthe river flood plains in the'O'Zone.

6. Each tree shall have a minimum oftwo-years'nursery-age and atrunk heightofsix feet.

7. A compliance affidavit, along with photographs showing before andafter plantation,duly protected by tree-guards/fences,shall be filed by • y the DCF concerned. Community participation in the plantation and maintenance of the trees may be encouraged. Copy ofthis order^be. served upon DCF(South),GNCTD. 2021:DHC:4449 <ifT r

A copy ofthis order be also served upon Mr.Gautam Narayan,ASC, GNCTD,(e-mail; g.narayanoffice@gmail.com; Mob. 9811411735), who has been assisting the court in number of cases apropos plantation of trees throughout the city, upon costs being levied on parties. Coordination in this regard may be done with him.

9. Once the trees are planted in coordination with the land-owning agency,the Executive Engineer(or officer of equivalent rank), shall ensure that they are duly watered and nursed for the next one year. The land falls in the Yamuna River basin and will only add to recharging ofthe ground water.
