JUDGMENT

1. After some hearing, Mr. Raj Singh, learned Counsel for the petitioner, seeks leave to withdraw this writ petition with liberty to institute a fresh petition challenging the promotion of persons who, according to him, are junior to him and have been promoted as Assistant Commandant in violation of the recruitment rules which envisages seniority-cum-fitness as the basis for such promotion.

2. Leave and liberty is granted as aforesaid.

3. The petition is disposed of.
