JUDGMENT
1. These petitions invoke Section 11(6) of the Arbitration and Conciliation Act, 1996("the 1996 Act").
2. Learned Counsel for the petitioner acknowledges that no prior notice invoking arbitration, under Section 21 ofthe 1996 Act has been issued by the petitioner to the respondent.
3. Sans such a prior notice, the petition under Section 11(6)ofthe 1996 Act is not maintainable,as Section 21 ofthe 1996 Act mandates that the arbitral proceedings would be deemed to commence on the date when the notice under Section 21 ofthe 1996 Act is issued.
4. Learned Counsel for the petitioner seeks leave to withdraw these petitions with liberty to re-approach the Court after issuing a Section 21 notice to the respondentand exhausting the statutoiy period thereafter.
