1. The present petition has been filed under Article 226/227 of the Constitution of India by the petitioner seeking issuance of writ of certiorari or other appropriate writ/order/direction(s) thereby quashing the stage-II result upto the extent where the petitioner declared as fail in documents verification and also further directing the respondents to call the petitioner for stage-III exam (Medical Examination Test) alongwith July 2021 Batch.

2. The petitioner belongs to the Economic Weaker Section (EWS) and has applied for post of Navik (GD) under OBC (Non Creamy Layer). The 2022:DHC:1303-DB petitioner had appeared for Stage-I and Stage-II Examinations and was declared passed. However, respondents through email dated 24.12.2021 informed the petitioner that during the document verification with regard to class 12th marks percentage mismatched with the online application and directed the petitioner to reply by 1100 hrs of 27.12.2021.

3. According to petitioner, at the relevant time, he was hospitalized and after being discharged from the hospital, he replied to the email of the respondents with explanation of four days delay. Petitioner requested to give a chance to present the documents and also attached all the documents with medical proofs. However, there was no response from the respondents and therefore, petitioner filed a representation dated 17.01.2022 requesting to consider his case and allow him to participate in the stage III medical examination. But since no reply to the representation was given by the respondents, therefore, the present writ petition has been filed.

4. Similar issues came up for consideration before this Court in case of Aman Yadav vs Union of India & Ors. in W.P.(C) 1704/2022 and the same were dismissed vide order dated 11.02.2022 by this Court.

5. In view of the above, we find no ground to entertain the present petition. It is accordingly dismissed. (SURESH KUMAR KAIT) JUDGE (SUDHIR KUMAR JAIN)
