1. Learned counsel for parties submit that the parties had already entered into compromise for the same, CM. APPL.37628/2021 was jointly filed by parties.

2. The present application has been filed by applicants/appellants seeking consideration of CM.APPL.37628/2021 wherein terms of Settlement have been mentioned and further seeking disposal of present appeal in view of the Settlement.

3. In view of the reasons stated in the present application, it is allowed.

4. Accordingly, present application stands disposed of. 2022:DHC:1180-DB RFA(OS) 24/2016 RFA(OS) 24/2016 & CM.APPL.37628/2021

5. Consequently, the present appeal and CM.APPL.37628/2021 are taken up.

6. The present appeal has been preferred by the appellants against the order dated 07.05.2015 passed by learned Single Judge in CS (OS) 1369/2010.

7. Learned counsel for appellants submitted that parties have already resolved the issues by entering into a Settlement and the terms of same are stated in para 5 of CM.APPL.37628/2021.

8. Learned counsel for appellants prays that in view of Settlement arrived at between the parties, the present appeal be disposed of.

9. In view of above, the present appeal as well as pending applications, if any, stand disposed of.

10. Parties shall remain bound by the terms of the Settlement stated in para 5 of CM.APPL.37628/2021.

11. The date already fixed also stands cancelled.
