1. Present appeal is listed on urgent mentioning by learned counsel for parties. CM.APPL.29020/2021

2. Present application has been filed by applicants/appellants under Order 22 Rule 4 Section 151 CPC seeking impleadment of legal heirs of respondent.

3. Vide order dated 19.01.2022, learned counsel for respondent had already submitted that he had no objection if the present application is allowed. 2022:DHC:1182-DB

4. In view of the reasons stated in the present application, it is allowed and the legal heirs of respondent are impleaded as respondent Nos. 1 (a), 1(b), 1(c) and 1 (d) in the array of parties. Amended memo of parties is taken on record.

5. Application stands disposed of. CM APPL. 37627/2021 (u/S. 151 CPC)

6. Present application has been jointly filed by parties.

7. Learned counsel for parties submit that the parties had already entered into Settlement and the terms of the Settlement are stated in para 6 of the present application.

8. Learned counsel for parties further submit that in view of Settlement arrived at between the parties, present appeal be disposed of.

9. In view of the reasons stated in the present application, it is allowed.

10. Accordingly, present application stands disposed of.

11. The present appeal has been preferred by the appellants against the order dated 07.05.2015 passed by learned Single Judge in CS (OS) 1370/2010.

12. Consequently, the present appeal is disposed of in terms of Settlement arrived at between the parties vide CM.APPL.37627/2021.

13. Parties shall remain bound by the terms of the Settlement stated in para 6 of CM.APPL.37628/2021.

14. Pending application, if any, also stands disposed of.

15. The date already fixed, i.e. 14.09.2022 stands cancelled.
