ORDER
1. These are four bail applications under Section 438 ofCr.P.C.filed on behalf of Rita Ahuja(Mother-in-law), Anil Ahuja(Father-in-law), Geetika Ahuja(Sister-in-law)& Ankit Ahuja(Husband)in BAIL APPLN.885/2021, 895/2021,897/2021 & 898/2021 respectively.
2. Learned counsel for the petitioner submits that interim protection was granted vide order dated 15.03.2021.Itissubmitted bythe learned counselfor the petitioner that the matter has been adjourned from time to time and vide order dated 09.02.2022, it was recorded that the matter has been amicably settled betweenthe parties for an amountofRs.8.[5] lacs vide Settlement/MoU dated 21.11.2021.
3. It is further submitted that the statements ofthe parties under Section 13B(1)ofHindu Marriage Acthave also been recorded and Rs.[3] laes as a part ofsettlement has been paid to the respondent No.2 after the recording offirst motion statement. Further the petition for second motion under Section 13B(2)ofHindu Marriage Act has been filed.
4. Learned APP for the State submits that applications be deferred since none has appeared on behalfofthe complainant.
5. Nothing has been brought on record today to presume that the parties have not entered into the settlement. Merely because the complainant has not appeared it may not be appropriate to defer the bail applications.
6. Petitioners have already joined the investigation and are no longer requiredforthe purpose ofrecovery.Consideringthefacts and circumstances ofthe case,in the eventofarrest,petitioners be admitted to bail on furnishing personal bond in the sum of Rs. 25,000/-(Rupees Twenty Five Thousand only)with onesuretyin the like amounttothe satisfaction oftheInvestigating Officer/SHO concerned. However the petitioners are directed to join the investigation as and when required. The applications are accordingly disposed of.
