JUDGMENT

1. This writ petition is directed against an order dated 4 May 2023, which reads as under: “Order of the Tribunal The matter is adjourned sine-die, as the matter is subjudice by the Hon’ble High Court. Chhabilendra Roul Ashish Kalia Member(A) Member (J)”

2. To our mind, this writ petition need not have even remained pending for so long, as it is obvious that the petition is misconceived. W.P.(C) 10221/2023

3. The order of the Tribunal merely adjourns OA 509/2021 sine die, as the issue before the Tribunal was sub judice before this Court in WP (C) 2110/2003[1].

4. Mr. Prakhar Bhatnagar, learned Counsel for the petitioner acknowledges, to a query from the Court, that the Tribunal could not have decided OA 509/2021 because of the interim order dated 12 December 2022, passed in the WP (C) 2110/2003.

5. In that view of the matter, there was obviously no error in the order of the Tribunal adjourning OA 509/2021 sine die, awaiting the outcome of the proceedings before this Court.

6. This writ petition is, therefore, thoroughly misconceived and is, accordingly, dismissed.

7. The next date of hearing i.e. 24 November 2025, stands cancelled.
