JUDGMENT
1. Present petition has been filed under Article 226 of the Constitution of India read with Section 528 B.N.S.S., 2023 and petitioner, inter alia, seeks directions in the nature of Habeas Corpus to the respondents to produce his wife Ms. Kriti Gupta before this Court.
2. As per the averments made in the petition, the petitioner and Ms. Kriti Gupta, solemnized their marriage on 15.05.2025 at Arya Samaj Mandir, Himgiri Enclave, in accordance with Hindu rites and ceremonies. The marriage was, subsequently, registered before the District Magistrate, Civil Lines, on 21.05.2025. After the marriage, the couple resided together at their matrimonial home in CC Colony, Delhi.
3. On 15.11.2025, during the petitioner’s absence, the father of Ms. Kriti Gupta allegedly took her away forcibly from the matrimonial home. On 18.11.2025, Ms. Kriti contacted the petitioner over a WhatsApp call and W.P.(CRL) 3815/2025 2 informed him that she had been taken to Hisar, Haryana against her wishes and was being compelled by her parents to undergo a second marriage.
4. Since then, the petitioner has been unable to contact or meet his wife, and her whereabouts have been purposely concealed.
5. Mr. Sanjay Lao, learned Standing Counsel informs that police was able to contact Ms. Kirti Gupta and she is, presently, residing with her family in Hisar, Haryana and does not want to go back to petitioner on account of certain personal issues.
6. Ms. Kriti Gupta, who is 30 years of age, has joined the proceedings through videoconferencing from a police station, situated near to her present location. She submits that she has, voluntarily, left the company of the petitioner and has chosen to live with her family and does not want to stay with him.
7. Learned counsel for the petitioner, on hearing the above stand of Ms. Kriti Gupta, seeks to withdraw the present petition with liberty to approach appropriate forum/ Court for seeking appropriate remedy, in accordance with law.
8. In view of the above, the present petition is dismissed as withdrawn.
9. Liberty as prayed is granted.
