ORDER
1. These seven petitions have been filed between the same parties,^ three under Section 15 ofthe Arbitration and Conciliation Act, 1996["the Act"], for termination of the mandate of the arbitrator appointed to adjudicate disputes between the parties arising out of various contracts, and four under Section 11 of the Act for appointment of an arbitrator to adjudicate disputes under different contracts.
2. All the seven proceedings were referred to arbitration of Mr.Rajiv Nayar, learned Senior Advocate, as the sole arbitrator by this Court. Details of the contracts and the orders of the Court are stated in a ARB.p. 724/2022 & connected mailers. 4. Mr. Nayar,the learned arbitrator, has appeared personally before the Court and expressed his inability to continue with the arbitration.
5. In these circumstances,learned counsel for the parties are ad idem that the arbitration proceedings have to be entrusted to a substitute arbitrator.
6. With the consent ofleamed counsel for the parties,the petitions are disposed of by referring the parties to arbitration under the aegis of the Delhi International Arbitration Centre,Delhi High Court,Shershah Road, New Delhi-110503 ["DIAC"]. The arbitrator will be nominated by the DIAC. It is made clear that the reference under each contract will be a separate reference and parties will be entitled to file independent claims and defences in each proceeding and to lead evidence independently.
7. The remuneration ofthe leamed arbitrator will also be computed as per the mles ofthe DIAC.
8. The parties will be at liberty to place the pleadings filed before the leamed arbitrator in the fi-esh proceedings,ifavailable.
9. It is open to the leamed arbitrator to decide the stage fi-om which the present proceedings will be taken up.
