1. Learned counsel for the petitioner submits that after the receipt of the recommendation from CVC, the disciplinary authority has exonerated the respondent.

2. Learned counsel for the petitioner further submits that an amount of Rs.10 lakhs on account of gratuity deposited with the appropriate authority may be released to the workman with interest accrued thereon. 2022:DHC:3330 W.P.(C) 1128/2021

3. Learned counsel for the petitioner submits that in these circumstances, he may be permitted to withdraw the present petition.

4. Mr. Aayush Agarwala, Amicus Curiae appointed by the Court submits that an appropriate order may also be passed for release of other retiral benefits including balance gratuity.

5. Learned counsel for the petitioner fairly submitted that now, there is no adversarial issue and the respondent may approach the petitionerauthority and retiral benefits and gratuity shall be released to the workman.

6. In view of the submissions made the writ petition is disposed of as withdrawn along with the pending application.
