1. Allowed, subject to all just exceptions.

2. Application stands disposed of.

3. Vide the present petition, petitioners are seeking directions to the respondents to grant and pay the revised pay along with other benefits to the petitioners in terms of the pay structure/pay fixation (Grade Pay 4200/Pay level 6) recommended for Lab Technicians under the 7th Central Pay Commission (CPC) Recommendations with effect from the 1st day of 2022:DHC:3687-DB January, 2016 with arrears.

4. On the aforesaid issue(s), petitioners made representation seeking implementation of 7th CPC recommendations qua new pay structure for Lab Technicians, however, the same was rejected by respondent No.2 on the ground that it has not received any instructions from respondent No.1 in this regard and since respondent No.2 is an organisation under respondent No.1, it cannot take any decision till necessary instructions are issued by respondent No.1 in this regard.

5. In view of above, we hereby direct respondent No.1 to take a final decision qua the issue(s) raised by the petitioners herein within three months from today and communicate the same to petitioners in writing within one week thereafter.

6. Needless to say, if the petitioners are still aggrieved by the decision of the respondent No.1/respondent No.2, they may approach appropriate forum, if so advised.

7. With the aforesaid directions, the present petition is disposed of.
