1. Vide the present petition, petitioner is seeking quashing of the final Enquiry Report dated 02.06.2018 passed by the respondent and thereby directions to the respondents to provide all the benefits to the petitioner during his suspension period and promotion with MACP benefits; directions to the respondents to release the arrears of pay and allowances to which the petitioner is entitled.

2. Learned counsel appearing on behalf of respondents submits that pursuant to Enquiry Report dated 02.06.2018, final decision has already been taken vide order dated 28.07.2022 and the said order is part of the counter-affidavit (Annexure-R[1]). 2022:DHC:3619-DB W.P.(C) 14540/2021

3. In view of above present petition has become infructuous.

4. Accordingly, the present petition is disposed of being infructuous. However, liberty is granted to the petitioner to challenge the said Enquiry Report dated 02.06.2018 and subsequent order dated 28.07.2022.
