1. Petitioner seeks setting aside and quashing of order dated 24.08.2022 passed by the Central Administrative Tribunal, Principal SANJEEV SACHDEVA, J. (ORAL) 2022:DHC:3827-DB W.P.(C) 13688/2022 2 Bench, New Delhi (hereinafter referred to as the ‘Tribunal’) whereby Original Application of the Petitioner had been adjourned to 19.10.2022.

Learned Senior Counsel for the Petitioner submits that Petitioner had earlier approached this Court by way of a petition [W.P.(C) 11907/2022] seeking early disposal of his Original Application, which was disposed of on 17.08.2022, noticing that the Original Application had been listed before the Tribunal for hearing on 24.08.2022.

Learned Senior Counsel for the Petitioner submits that this Court was not informed on 17.08.2022 by the Respondents that they had filed an application, which was listed before the Tribunal on 08.08.2022 and the matter was adjourned to 14.10.2022. He submits that when the Original Application was listed before the Tribunal on 24.08.2022, the Bench adjourned the proceedings to 19.10.2022 in view of the fact that on an M.A. filed by the Respondents, a Coordinate Bench of the Tribunal had given a date of 14.10.2022.
4. Issue notice.
5. Notice is accepted by learned counsel appearing for the Respondents.
6. Learned Senior Counsel for the petitioner submits that the M.A. filed by the Respondents i.e. M.A. No.2197/2022 sought to place on record certain additional documents.
7. Learned Senior Counsel under instructions submits that he has no objection to the application being allowed and additional documents being taken on record of the Tribunal. W.P.(C) 13688/2022 3
8. In view of the above statement, we allow M.A. No.2197/2022 pending before the Tribunal. Additional documents filed along with the application are taken on record of the Tribunal. Application is accordingly disposed of. Consequently, the matter shall not be listed before the Tribunal on 14.10.2022 on the said M.A.
9. Learned Additional Solicitor General appearing for the Respondents submits that averments in the petition are contrary to record and are disputed.
10. Keeping in view the fact that the Original Application had been adjourned to 19.10.2022, we dispose of this petition along with pending application, requesting the Tribunal to dispose of the Original Application on 19.10.2022 or soon thereafter as may be possible.
11. It is clarified that averments made in the petition shall not be construed to have been either admitted by the Respondents or accepted by the Court in any manner.
