JUDGMENT
SANJEEV SACHDEVA, J (Oral)

1. Learned counsel for the petitioner submits that petitioner shall 2022:DHC:4279-DB be filing an application for advancing the date of hearing before the Tribunal so that the entire petition can be disposed of by the Tribunal expeditiously.

2. In view of the above, the petition is disposed of with the following directions:-

(i) Liberty is granted to the petitioner to apply to the Tribunal for advancing the date of hearing. In case such an application is filed, the Tribunal shall sympathetically consider the same.

(ii) In case the Tribunal is not in a position to dispose of the petition on merits expeditiously, the Tribunal shall consider the application of the petitioner for interim relief afresh without being influenced by anything stated in the order dated 19.09.2022.

(iii) Petitioner shall be at liberty to join the posting at Patiala or in the alternative, apply for leave in accordance with the rules. In case an application for leave is filed by the petitioner, respondent shall consider the same at Delhi itself without requiring the petitioner to physically join at Patiala.

(iv) It is further directed that this entire exercise shall be without prejudice to the rights and contentions of the parties and without prejudice to the Original Application filed by the petitioner before the Tribunal.
