1. Mr. Kunal Vats, learned Counsel for the petitioner points out that the petitioner’s application under Order XV-A read with Order XXXIX Rule 10 of the Code of Civil Procedure, 1908 (CPC) is pending consideration since May 2022 and, that since October 2021, the respondent is in arrears of rent in respect of the suit property. The matter, he submits, is repeatedly being adjourned without any decision being taken on the application.

2. In view thereof, this petition is disposed of with the request to the learned Civil Judge to take a decision on the petitioner’s application Order XV-A read with Order XXXIX Rule 10 of the CPC on 17th November 2022, when the matter is next listed before her, with CM(M) 1064/2022 no order as to costs.

3. Miscellaneous applications are also disposed of.
