1. Present application has been filed for condonation of delay of 10 days in filing the present petition.

2. For the reasons mentioned in the application, the delay of 10 days in filing the petition is condoned.

3. The application stands disposed of. C.R.P. 240/2019 & CM APPL. 46398/2019 (stay)

4. Learned senior counsel for the petitioners submits that he would be satisfied if the certified copy of judgment passed in Civil Suit bearing no.425588/2016 dated 30.03.2019 titled as Ram Kishan vs. Moti Lal & Signing Neutral Citation Number 2022/DHC/004968 C.R.P. 240/2019 Ors. is allowed to be taken on record and the same is considered by learned trial court in accordance with the law. Learned senior counsel submits that if this is allowed, he has instructions not to press present petition and the petition may be disposed of accordingly.

5. Learned senior counsel for the respondents has gracefully submitted that he has no objection to the same and the certified copy of Civil Suit bearing no.425588/2016 dated 30.03.2019 titled as Ram Kishan vs. Moti Lal & Ors. may be allowed to be taken on record.

6. In view of the submissions made by the learned senior counsel appearing for the petitioner, learned trial court is directed to take the certified copy of judgment in Civil Suit bearing no.425588/2016 dated 30.03.2019 titled as Ram Kishan vs. Moti Lal & Ors. on record and consider the same in accordance with law.

7. The cost imposed upon the petitioner by the learned trial court be reduced to Rs.5,000/-.

8. With the above directions, the petition along with the pending applications is disposed of.
