JUDGMENT

1. Petitioner/defendant has assailed order dated 21.08.2025 of the learned trial court, whereby cross-examination of PW[1] was closed.

2. Although there is no infirmity in the impugned order, but learned counsel for respondent/plaintiff, solely in the interest of expeditious disposal of the suit, is agreeable to grant of one and only one opportunity to the petitioner/defendant to conclude cross-examination of PW[1], subject to the condition that PW[1] is paid the total amount of return airfare for two dates and hotel stay for total four days in advance through counsel.

3. The matter was passed over, during which learned counsel for both sides took instructions from their respective clients.

4. As requested by both sides, the present petitioner/defendant is granted one and only one opportunity to conclude cross-examination of PW[1] subject to following conditions: i. Both sides shall appear before the learned trial court on 17.12.2025 at 02:00 pm and on that day, the learned trial court shall fix a date according to the convenience of the trial court for recording the remaining crossexamination of PW[1]; ii. On or before 20.12.2025, learned counsel for respondent/plaintiff shall deliver, under acknowledgment, copies of the return air tickets and the hotel bill for the visit dated 18.10.2024 to learned counsel for petitioner/defendant; iii. On or before 25.12.2025, learned counsel for petitioner/defendant shall transmit to learned counsel for respondent/plaintiff the amount of return air tickets for 21.08.2025 (when PW[1] had appeared) and for the next date of cross-examination of PW[1] calculated according to the cost of return air tickets that had been booked by the PW[1] for coming on 18.10.2024; iv. The hotel bills to be borne by the petitioner/defendant shall be only for one night-two days each for the visit dated 21.08.2025 and for the next visit of PW[1] for his cross examination calculated according to the hotel bills for the visit dated 18.10.2024 of PW[1].

5. Accordingly, with consent of both sides, the petition and the accompanying applications stand disposed of.
