REVIEW PET. 290/2025, CM APPLs. 28393/2025 & 28394/2025
JUDGMENT

1. The only ground urged by Mr. Ankit, appearing for the review petitioner, is that there were only three general category vacancies out of the 11 vacancies mentioned in para 14 of the order under review and the petitioner was the eighth candidate in the wait list.

2. He does not dispute the fact that none of the seven candidates above the petitioner approached the Court.

3. He is also not in a position to state that those seven candidates were still available at the time when we had passed the impugned W.P.(C) 4869/2021 order.

4. In that view of the matter, as the petitioner was the first candidate in the wait list who had approached the Court, there is no reason for us to review our order on this ground.

5. The second ground taken was that the unfilled vacancies had been carried forward and filled thereafter. We have already dealt with this aspect in our order. We have specifically noted that, in the absence of any directive to the effect that the wait list would not have been operated a second time, there was no justification for the respondents not to do so.

6. We, therefore, do not find any cause to review our order.

7. The review petition is accordingly dismissed. Pending applications also stand dismissed accordingly.

8. Compliance with our order be ensured within four weeks from today.
