CRL.M.A. 27264/2022 (exemption)
Exemption is allowed subject to all just exceptions.

1. This is an application under Section 439 Cr. P.C. seeking interim bail for one month in FIR No. 251/2021 registered at PS Safdarganj Enclave under Section 302 IPC for the purpose of completing the formalities in view of the migration of pension scheme to SPARSH.

2. Learned counsel for the petitioner submits that the petitioner is a pensioner of Indian Army. It has been submitted that now the pension scheme of the petitioner has migrated to SPARSH which is a centralized system and for which fingerprints and photographs of the petitioner are urgently and essentially required.

3. Learned counsel submits that the petitioner may also have to visit Allahabad Head Office and Zilla Sainik Board for the same. Learned counsel submits that he had moved an application for interim bail however, the learned ASJ-03 (south), Saket Courts, New Delhi vide order dated 13.12.2022 has disposed of the bail application and allowed the petitioner to complete the procedure of his pension by visiting the concerned departments in judicial custody on 14.12.2022 and 15.12.2022 at his expenses.

4. During the course of submissions, learned counsel submits that he would be satisfied, if the petitioner is allowed to visit the concerned offices/Banks in Delhi for completing the formalities in view of the migration of pension scheme in judicial custody.

5. Learned APP for the State submits that he would have no objection, if the petitioner is allowed to visit the concerned offices/Banks in judicial custody for two days for completing the formalities.

6. Let the petitioner visit these offices/Banks in Delhi for completing the formalities in custody on 18.01.2023 and 19.01.2023. The petitioner shall inform the Superintendent of Jail at least one week in advance address/location of the offices/Banks he wants to visit.

7. The Superintendent Jail shall ensure that the petitioner is able to visit these offices/Banks in Delhi for completing the formalities on 18.01.2023 and 19.01.2023 from 10:00 a.m. to 5:00 p.m.

8. In case, the petitioner is required to visit Allahabad for completing some formalities, he may approach the learned Trial Court afresh with an appropriate application as per law.

9. With these observations, the present petition stands disposed of.
