JUDGMENT

1. After some hearing, ld. Counsel for respondent submits that he has no objection if the civil suit bearing No.

CS DJ 484/2021 titled as “Rajesh Malik Vs. Neetu Suri” pending in the Saket Courts is transferred to this Court, without prejudice to the rights and contentions of the parties.

2. It is noted that other litigation pending between the parties viz. CS No. 230/2022 titled as “Neetu Suri Vs. Rajesh Malik & Anr.”, filed by the petitioner herein is pending before this Court and Test Case No. 33 of 2022 titled as “Rajesh Malik Versus Govt. of NCT of Neutral Citation Number: 2023:DHC:2146 Delhi & Ors.” filed by the respondent herein is also pending before this Court. In view thereof, it would be appropriate if the civil suit filed on behalf of respondent herein for recovery against the petitioner herein is transferred to this Court.

3. The parties before this court are brother and sister and the dispute between the parties is essentially in the nature of family dispute.

4. In view of the aforesaid, the present transfer petition is allowed and civil suit bearing No.

CS DJ 484/2021 titled as “Rajesh Malik Vs. Neetu Suri” is directed to be transferred to this Court from the court of Smt. Gurmohina Kaur, Ld. Additional District & Sessions Judge, South, Saket Courts, New Delhi.

5. As regards the submission on behalf of the petitioner for consolidation of the said suit with the pending cases in the present court, this issue shall be considered by the court dealing with the said cases in the Original Side.
