JUDGMENT
1. Though an application for early hearing being CM NO. 15014/2023 has been filed on behalf of the petitioners, during the course of the hearing, learned counsel for the petitioners submits that he has instructions to give up all the reliefs as prayed for in the present writ petition except the prayer relating to issue of seniority.
2. It is submitted on behalf of the petitioners that the present writ petition has been filed as the petitioners were aggrieved by the fact of their non-promotion to the post of PGT English.
3. It is submitted that now there are three posts of PGT English in the respondent school, which are required to be filled by way of promotion.
4. Thus, the learned counsel appearing for the petitioners submits that the petitioners shall be satisfied in the present writ petition if the respondent school is directed to fill the three posts of PGT English by holding DPC.
5. Learned counsel further submits that as far as the issue of seniority is concerned, the petitioners shall agitate the same in separate proceedings, if they are still aggrieved by any action of the respondent.
6. Mr. Atul Jain, learned advocate appearing on behalf of the respondent school confirms the fact that at present there are three posts of PGT English in the respondent school which are required to be filled by respondent school by way of promotion.
7. In view of the submissions made on behalf of the petitioners, the present writ petition is disposed of with directions to the respondent school to fill up the three posts of PGT English by way of promotion by holding DPC. In case petitioners are aggrieved by any action of the respondent school on the issue of seniority, the petitioners have liberty to seek their legal remedies, as per law.
8. It is expected that the respondent school shall hold the DPC for filling up the post of PGT English expeditiously, preferably within a period of eight weeks from today.
9. It is clarified that this Court has not expressed any opinion or given any finding on the seniority of either of the parties.
10. With the aforesaid directions, the present writ petition is disposed off. Consequently, C.M. no. 15014/2023 is also disposed off. MINI PUSHKARNA, J
